Terms of Service

1. Who we are

NoahX Digital ("NoahX," "we," "us") provides an AI-powered business growth platform for small businesses: a subscription that includes a professionally built AI Smart Website, hosting, maintenance, and — depending on your plan — additional marketing, automation, and software capabilities. These Terms govern your use of noahxdigital.com and any NoahX subscription or one-time service. By subscribing or using the site, you agree to them.

2. Plans, billing & price protection

• Subscriptions are billed monthly in advance through our payment processor, Stripe. We never see or store your full card details.
• Plans are month-to-month. There are no long-term contracts, no setup fees, and no cancellation fees.
• Published prices are flat. Once you subscribe, your price is grandfathered: a future price change never migrates your active subscription — your rate stays until you choose to change plans.
• Some capabilities are labeled "coming soon." They are in development and are never billed as live features.
• One-time engagements (such as a Launchpad sprint) are quoted in writing before any work begins.

3. Pause or cancel anytime

You may pause or cancel your subscription at any time by emailing hello@noahxdigital.com or using your client portal. Cancellation takes effect at the end of the current billing period; we don't charge you again after that. Paused subscriptions retain your website and data for up to 90 days so you can resume without starting over.

4. What you own, what we operate

• Your content is yours. Your business name, logo, copy you provide, photos, customer data, and anything in your Brand Vault remain your property.
• We operate the platform. The NoahX operating system — the software, designs, templates, components, AI integrations, and dashboards that run your site — is licensed to you for the duration of your subscription, not sold.
• If you leave, we will export your content and data (pages' text and images, form submissions, customer records we hold) in a portable format on request, free of charge, for up to 90 days after cancellation. Hosting of your NoahX-built site ends with your subscription.
• Your domain name, if you own one, is always yours; we will assist with repointing it.

5. Our service commitments

• We aim to launch new AI Smart Websites within 24–72 hours in most cases, and to complete standard requests within 24–72 hours. These are service targets, not guarantees; complex projects get written timelines.
• Every deliverable requires your approval before it goes live.
• Plan capacity (such as active request slots) is described on the pricing page; it is a fair-use mechanism, not an hourly quota.

6. Acceptable use

You agree not to use NoahX services for anything unlawful, deceptive, or harmful — including sites that infringe others' rights, distribute malware, or misrepresent your identity or offering. You are responsible for the accuracy and legality of the business information and content you provide (including claims, licenses, and pricing shown on your site). We may suspend service for material violations after notice.

7. AI features

Some plan features use artificial intelligence (for example, the site assistant, content generation, and analytics summaries). AI output is reviewed under our human-approval workflow before it goes live on your site, but AI can make mistakes; you should review AI-assisted content that represents your business. Where a feature is a preview or uses sample data, it is labeled as such.

8. Disclaimers & limitation of liability

Services are provided "as is" to the maximum extent permitted by law. We do not guarantee specific business outcomes (rankings, lead volumes, or revenue). To the fullest extent permitted by law, NoahX's total liability for any claim arising out of the services is limited to the amounts you paid us in the three (3) months preceding the claim, and neither party is liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes to these Terms

If we change these Terms in a way that materially affects you, we will post the update here and note the date above; continued use after the effective date constitutes acceptance. Price grandfathering (Section 2) survives any Terms update.
